In the course of storing or archiving personal data, GreenFlex no longer uses this data.<\/em><\/p>\n<h2><a name=\"_Toc64449308\"><\/a>5.\u00a0Recipients or categories of recipients of the data<\/h2>\n<p>Personal data and information is processed by GreenFlex Personnel (i.e. all natural persons, whether salaried or not by GreenFlex), and in particular by the communication departments and management.<\/p>\n<p>The information may also be passed on to certain \u201cService Providers\u201d (any natural person or legal entity who has entered into a service agreement with GreenFlex) to enable GreenFlex to provide you with the service(s) offered. These Service Providers act on the instructions of GreenFlex, and GreenFlex ensures that the data transmitted is processed only in the context of the performance and provision of services offered, unless the Data Subject has subscribed directly to the services of a Service Provider or has consented to the Service Provider using his\/her data for the Service Provider\u2019s own purposes.<\/p>\n<h2><a name=\"_Toc64449309\"><\/a>6. Transfer of personal data<\/h2>\n<p>The data may be transferred to our subcontractors for the services that GreenFlex offers to the Data Subjects.<\/p>\n<p>Any time that data is transferred to a third country outside of the European Economic Area, it is carried out in accordance with applicable laws and in a way that ensures that data are properly protected.<\/p>\n<p>GreenFlex implements all the means at its disposal to ensure the protection and confidentiality of the data transferred and, in particular, ensures that Service Providers located outside the European Union ensure a level of data protection and the rights of the Data Subjects (and in particular their privacy) under conditions equivalent to those guaranteed within the European Union by the GDPR.<\/p>\n<p>In particular, GreenFlex ensures, where possible, that standard contractual clauses, such as those validated by the European Commission, are signed with its Service Providers, and provides additional safeguards to ensure that Service Providers comply with the data processing and protection requirements as set out in the GDPR. GreenFlex ensures, for example, that changes in the legislation of the country where the Service Providers are located are not likely to have a significant negative impact on the guarantees and rights of the Data Subjects. Failing this, GreenFlex asks its Service Providers to process personal data exclusively in the territory of a Member State of the European Union, unless GreenFlex has given its express permission and the Service Provider has given special guarantees.<\/p>\n<h2><a name=\"_Toc64449310\"><\/a>7.\u00a0Security and confidentiality of personal data<\/h2>\n<p>GreenFlex implements appropriate measures to ensure a level of protection appropriate to the risk in terms of confidentiality, integrity, availability and resilience of systems and, in particular, to prevent personal data from being distorted, damaged or communicated to unauthorised third parties.<\/p>\n<p>GreenFlex regularly monitors internal procedures as well as technical and organisational measures to ensure that the processing under its responsibility is carried out in accordance with the requirements of current legislation on the protection of personal data and the protection of the rights of the Data Subjects.<\/p>\n<p>Security measures are also implemented in accordance with the GreenFlex IT Charter and the GreenFlex Rules of Procedure.<\/p>\n<p>When personal data is transferred to Partners or Service Providers, GreenFlex will use all the means at its disposal to ensure data protection and confidentiality.<\/p>\n<h2><a name=\"_Toc64449311\"><\/a>8.\u00a0Data processing rights and freedoms requests relating to the processing of personal data<\/h2>\n<p>In accordance with the regulations in force, any Data Subject may ask GreenFlex, through its Data Protection Officer (DPO), whose contact details are below, to exercise:<\/p>\n<ul>\n<li><strong>a right of access<\/strong>: asking GreenFlex whether it holds data concerning them, and requesting a communication to verify its content (<a href=\"https:\/\/www.cnil.fr\/fr\/le-droit-dacces-connaitre-les-donnees-quun-organisme-detient-sur-vous\">https:\/\/www.cnil.fr\/fr\/le-droit-dacces-connaitre-les-donnees-quun-organisme-detient-sur-vous<\/a>);<\/li>\n<li><strong>a right to rectify<\/strong>: this implies the rectification of inaccurate or incomplete information concerning the Data Subject.
